The Torah community has grown exponentially. The progress and achievements in Kashruth have exceeded even the greatest dreams of our ancestors. The translation and marketing of the Torah is, in its own words, ‘monumental’. The next step in our communal evolution is the rise of the Bais Din system. Topics to be discussed:
1.) Collecting money, evicting tenants and seizing assets. The latest opinions and a detailed discussion on why these do not require a plaintiff to go to Bais Din.
2.) Statute v. Discretion: a case study. The real guidelines as to when the Torah law applies, when the secular applies and why a Bais Din has discretion at all times. Special emphasis on the standard for ‘abuse of discretion’ and why it does not apply to a Bias Din.
3.) Due process: Fact or Fiction - An in-depth study into the why’s and wherefore’s of procedural and substantive due process and how this seemingly humane concept actually flies in the face of Bais Din jurisdiction, is contrary to Bais Din process and is to be eschewed when convening a Bais Din.
